The THQ logo - Image 1First, it was the WWE versus THQ and Jakks Pacific; now it's THQ versus Jakks-Pacific. Thing is, the video game publisher has declared a victory against the toy maker with regards to the two companies' royalty dispute. Is there any chance for another lawsuit dismissal?

WWE SmackDown vs. Raw 2008 - Image 1 THQ and JAKKS have revealed the details for their global promotional campaign for WWE SmackDown vs. Raw 2008 (PS3, PS2, PSP, Xbox 360, Wii, DS). The multi-million dollar marketing strategy will include a global TV campaign, print ads, tournaments, and the franchise's first-ever launch event at Toys'R'Us.

WWE SmackDown vs. Raw 2008 is scheduled for a November 13 release in North America.

THQ and JAKKS Pacific, Inc. understand your need and only yesterday announced that they'll be bringing WWE Smackdown vs. Raw 2008 for multiple gaming platforms.


Yes, sirree, the WWE Smackdown vs. Raw franchise will be debuting on the Wii, the DS and the PS2 consoles, as well as being developed for the Xbox 360, PS3, and the PSP. This marks the WWE franchise's largest cross-platform market launch. Smackdown vs. Raw 2008 comes out fall.

What to expect from this 2008 version of the market-leading wrestling franchise? There's a debut of Superstar Fighting Styles, featuring eight unique styles, each having its own strategy and exclusive attributes. There's a new Struggle Submission System that will make use of the game's analog controls. You may now control the amount of pressure you apply to your opponents.

In addition to the above-mentioned gameplay details, the game also features a significant Extreme Championship Wrestling presences, with a variety of Superstars, arenas and weapons. There are new rosters, more environmental hotspots, a combined Season and General Manager mode, improved out-of-ring action, enhanced online community support - what more could you ask for?

thqWe've already reported that WWE has filed a lawsuit against THQ. There was another lawsuit filed back in 2004 against the THQ-Jakks Pacific partnership when WWE found out that THQ had been selling WWE-licensed games in Japan and other parts of Asia.

Today, we got an inside look at the details of the lawsuit. It showed that THQ had allegedly been sublicensing the games. It says that when "THQ submitted package approval request forms in 2004 for a game to be sold in Japan, the publisher listed Yuke's as 'THQ's regional distributor,' and not a sublicensee." In fact, WWE and THQ-Jakks Pacific had signed an agreement that specifies "sublicensing to any company that is not wholly owned by the joint venture without prior written consent from WWE" is prohibited.

THQ had at first denied the allegations, but now they are also out to prove that selling video games in Asia did not cause a breach of the video game license agreement.

Is it about collusion? Is it about license abuse? Bottom line is, WWE wanted to terminate the license agreement with THQ, get paid for the damages, and earn back the royalties that they're supposed to have gained in the alleged illegal THQ sublicensing. We'll see what happens as more details about the case unfold in the future.

WWEOn October 19, 2004, a lawsuit against THQ Inc. and JAKKS Pacific LLC was filed by the World Wrestling Entertainment (WWE) in the U.S. District court. This is about the toy license with WWE and the video game license between WWE and the joint venture company operated by THQ Inc. and JAKKS Pacific Inc.

Named WWE Action, World Wrestling Entertainment, Inc. claimed that both companies violated their property rights by improper sales of WWE video games in Japan and other Asian territories. Due to this, WWE is seeking termination of video game license of both companies along with monetary damages.

THQ and JAKKS Pacific denied the allegations in a press release recently, claiming that the lawsuit is "without merit" and they are planning to prove their case in court. One of the WWE video games from the joint venture is WWE Smackdown vs Raw 2006 for the PSP and PS2 consoles which was released in U.S. and Canadian territories on November 15 last year. With the lawsuit at hand, we don't know if the release of the game will be fulfilled. But we are keeping our fingers crossed that this case won't affect other WWE releases from THQ and JAKKS Pacific since so many WWE fans have been waiting for this.
